• “Content” includes information, files, text, images, social media links, digital business cards, notes, or any material submitted through or generated by the Service.

2. ELIGIBILITY

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under 18, you must have parental consent. You may not use the Service if you are barred from receiving services under the laws of your country.

3. ACCOUNT REGISTRATION

You are responsible for:

• Maintaining the confidentiality of your login credentials.

• All activity under your account, whether authorized or not.

• Providing accurate and current information.

You must not:

• Impersonate someone else.

• Use another person’s account without permission.

4. LICENSE AND INTELLECTUAL PROPERTY

All intellectual property rights in the Service and its content, including design, text, software, graphics, logos, and databases, are owned by or licensed to NEXJE.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Service.

• Use automated tools (scraping, bots) without permission.

5. USER CONTENT AND LICENSE

You retain ownership of any User Content you submit. By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, store, reproduce, modify, adapt, publish, and display such content solely for the purpose of operating and improving the Service.

You represent and warrant that:

• You have all rights necessary to grant the license.

• Your content does not infringe any third-party rights or violate any law.

6. SUBSCRIPTION TERMS

We offer both Free and Premium plans:

Free Plan:

• 20 contact limit

• 2 social media integrations

• 20-word limit on notes

• Watermarked digital card

Premium Plan:

• Unlimited contact storage

• All social media integrations

• Unlimited notes

• No watermark

Subscription Auto-Renewal:

Paid subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing cycle.

7. DISCLAIMERS

The Service is provided "as is" and "as available". We do not guarantee:

• That the Service will be uninterrupted or error-free.

• The accuracy or reliability of AI-generated follow-ups or contact tracking.

To the maximum extent permitted by law, we disclaim all warranties, including:

• Merchantability

• Fitness for a particular purpose

• Non-infringement

You are solely responsible for the consequences of using or relying on the Service.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, NEXJE shall not be liable for any:

• Indirect, incidental, special, consequential, punitive, or exemplary damages

• Lost profits or business interruption

• Data loss, corruption, or unauthorized access

Our total liability shall not exceed the amount you paid to us in the six months preceding the claim.

9. PROHIBITED USES

You agree not to use the Service to:

• Violate any local, state, national, or international law

• Harass, abuse, defame, impersonate, or intimidate others

• Distribute viruses, malware, or harmful code

• Collect or store personal data of other users without consent

We reserve the right to suspend or terminate accounts found in violation.

10. THIRD-PARTY SERVICES

The Service integrates with third-party services (e.g., Apple Wallet, LinkedIn, social media). We are not responsible for the content, policies, or practices of these services.

11. TERMINATION

We reserve the right to:

• Suspend or terminate your access to the Service at any time, for any reason, with or without notice.

• Retain or delete data associated with terminated accounts in accordance with our Privacy Policy.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless NEXJE and its affiliates from any claims, liabilities, damages, and expenses (including legal fees) arising out of your use of the Service, violation of these Terms, or infringement of third-party rights.

13. GOVERNING LAW

These Terms shall be governed by the laws of the State of Michigan, United States. You agree to submit to the exclusive jurisdiction of the courts in Michigan.

14. CHANGES TO TERMS

We may revise these Terms at any time. The latest version will always be available in-app or on our website. Continued use of the Service constitutes your acceptance of any changes.
